I have a plot in a gated community. The builder next to this plot has dumped mud and sand on my plot. Will this qualify as 'trespassing' and any recommendations on what cna be done to get the mess cleaned up? thanks!!

I purchased a 2 BHK flat and am about to take a possession. As part of it when I wanted to take the 'occupancy certificate' before my move -in, but builder has made it abunduntly clear that he WILL not issue me a occupancy certificate. What rights do I have here and how do I get this certificate?
