Post by sbhat »

Hi All,
I had searched this fourm but i could not able to get the information whatever i am looking for. How to know whether an Layout has an leagal dispute or not. I know advocate will come to know about this by seeing the paper. But builder/land developer may not provide the document which has this information. Sorry if i am asking silly question. But i wanted to know this because in the current situation ( because of land price) builder can do that ( i am not saying all the builder but i feel there is rom for this).
Please give your suggestion.

Probably not a direct answer to your question. But recently, we had gotten documents for a property , where the allottment letter had mentioned one WP no - which means Writ Petition Number. I was able to get a lot of information about this writ petition from the two below links of Honourable Karnataka High Court. Also , I realized that, these links allow you to search with names as well. Meaning, if your seller/developer/builder has been involved directly in a case/dispute, it will be listed here.

http://judgmenthck.kar.nic.in/judgments/
http://causelist.kar.nic.in/caseStatus_CaseNumber.asp

First link, when you give just the name, it pops up a lot of information about any cases filed/involved by the name given.

Allotment letter??. Are you referring to BDA site?. BDA sites alloted even though there was a case on land?. Can you please elaborate slightly?

Thanks Jackalbda.
If the developer/builder might brought the disputed land knowingly/knowingly from the third person. Will advocate will able to findout the issue by just seeing the paper which developer/builder provides.

@jpnagarprop

Yes, the plot was allotted for him as a compensation for a revenue plot he had, in the land acquired by BDA. Owner had filed a Writ Petition against BDA/Karnataka Govt/Village Panchayat . As part of the judgement, the owner was to get a BDA plot alloted, and in the allotment letter, it was mentioned that so much amount was deducted from the BDA's deposit money to be paid by the owner, in return of the value of the land acrquired from him.
