Case type: Civil Appeal
Case Number: 5016
Year: 2016

We need to wait till supreme court makes NGT ruling prospective or quashes it. Currently it is posted for hearing on Friday 13th July 2018.

Listed for 24/9/18. Not sure when this postponements will stop and actually go to trial.

Looks like this is going to be never ending story.... I have not heard goverment planning to compensate people who are impacted.

Have you people seen any houses being built which are in new buffer zone.

I heard for the BDA auction sites, they are returning back the money. However, for first allotment, they are just waiting for the appeal to be finalized.

Really?? Thsi sounds illogical and impractical. Returning back money on many years back auctioned site. Some of these sites have changed hands and now different owners. What would be amount of returned money (considering appreciation and interests or)and how will it be handled ?

As per the website.... https://www.sci.gov.in/case-status ...... case was filed in sept/oct 2016, it has been two years and still there is no clarity
the way court work for common people, i dont think we may get any judgement from court in near future.

it so strange.... that 90% houses have come up in my layout, and remaining 10% are going to remain vaccant .....
i am still unable to visulize how, will this help restoring lake? where in all the houses constructed near to lake would continue to live,
however few who could not construct then and now fall in this new buffer zone are victims..... :(

There is no positive news coming for those of us impacted by NGT restrictions. Not sure, what's in fate for us. It has been so stressful and traumatic from last 2 years.
Saw this news today:-

Hi Amit, Where did you get this info? 2nd Jan 2019 is quite far away.. Why is this case going so slow? A judgement delayed is judgement denied.

The reason these cases go slow and often goes against interest of individual site owners is because of no representation of interest of site owners in court room.

Mostly big builders and devopers represent the buyers side and perceived to be powerful people and thus have little sympathy.

I do not mean to say that lakes are not being destroyed however there is no coorelation between cause and actions.

I think untill and unless affacted population comes together runs a social media campaign hire a lawysr you will not get justice.

One sucessful example of such campaign is abolition of Life time tax on vehicles for more than 30 days in Karnataka.

One Mr. Waseem Menon started campaign on change.org and facebook got 1L signatures. Meet Union ministers and went to HC and then SC and won the case.

Now let me come to the point why all such issues be ot A vs B khata or this NGT order happen in Bangalore.
Guys you need to understand demand vs supply gap principle of economics
As long as supply of land with clear legal titles can be controlled its price can be kept . So various front ends pop up to limit the supply.

Take example of B khata site and illegal layouts in CMC. In 90s they were fully legal as per CMC norms. One fine day BDA extended its jurisidiction for approvals and finally in 2007 BBMP merged CMCs blocking khata transfers. There are perfectly managed private layouts with trees and STP with villas but illegal and adjoining them are chaotic layouts with BBMP khata and 5 stories on 30x40 sites.
Again perfect example of limiting supply and socialist mindset of making individual higher income person as villain.

---Quite a few people (mainly big parties, including karnataka government) have filed a case against this in supreme court. The outcome of supreme court will be aplicable for all. Since this case is heard only in supreme court, it is very costly for individual site owners to fight, unless he or some one in his family are lawyer in SC.

Once a cases gets into clutches of court,it gets into deadlock situation, since court takes years and years to give judgement....

i have seen building coming up near to lake, who had purchased the land as per the old laws are constructing house. i am not able to get hold of owners to know how they got the plan approval.

@@@ Shailesh--- 2nd Jan is the next hearing. if you visit the supreme court website and check for details on this case, u would geto know when is the next hearing.
