No disabled quota in site allotment, BDA tells HC
BENGALURU, dhns: The Bangalore Development Authority on Monday informed the High Court that it cannot grant sites at concessional rates to the disabled.
BDA advocate KN Putte Gowda submitted to the court that it is a policy decision that sites cannot be granted at concessional rates as the land to form the sites have been purchased by private parties. The development authority, however, has reserved 1% of sites for the disabled.
Karnataka Rajya Vikalachethanara Rakshana Samithi has filed a PIL seeking directions to the BDA to set aside the notification issued on October 14, 2015, inviting applications for the allotment of 5,000 residential sites at Kempegowda Layout in Bengaluru. The petitioner's counsel Jayna Kothari argued that persons belonging to SC/ST category are getting sites at concessional rates. The BDA advocate said that the authority is not allotting any sites at concessional prices to any category of persons.
The petitioner contended that the notification does not provide 3% reservation in allotment of sites to persons with disabilities. They also said that there was no mention of 50% concessional rate as per Section 43 of the Persons with Disabilities (Equal Opportunities, Protection of Rights & Full Participation) Act, 1995. The Disabilities Rules, 2006, also refers to concession, the petitioner contended.
The petitioner's counsel said that government has not filed its statement of objections in the matter. The bench directed the state government to file objections in four weeks and adjourned the hearing.

Latest news is, BDA shall publish the final List on coming Friday (7-Oct-2016) or on Monday (10-Oct-2016, even though it is holiday they will update the BDA website). Commissioner is putting presser on both allotment and Engineering department. Otherwise we need to forget it until 3rd week of October.
As all of us know Govt is struggling in other cases. For everything they need approval. And also BDA is making un-necessarily delay. They are testing our patience.

When i called KG layout dedicated phone line 080 23440480 answer is changed,Initially they used to tell 1st week of oct now they are telling this month,delay agathe sir antha.

I have two doubts at this moment:
1. If they announce the final list for the current allotment and call for the next 5000? Is there a chance of price rise for next set of allotments?
2. I saw some post about selling the allotted site, is it possible?

My Inputs:
1] Definitely there would be price raise of 100 to 200 Rs per SFT. Whatever BDA had set the rate is for first phase and the price is more than one year old.
2] We cannot sell the allotted site legally. Because the site is under the execution of “Lease cum sale dead” scheme. In case you sell the site, buyer will be in danger zone for ten year. Any point of time BDA can allot new site because of some issues. Risk is more for buyer.
