Opinion / Suggestion required in buying a property

Hi,

Need an expert opinion/suggestion from the Forum in buying an independent house which comes under Babusabarapalya, Chellakere Dhakale, Krishnarajapura Hobli.

The question now arises is that the above said property constructed in a layout which was formed in 1995 with the Survey No having 4 Acres 10 Guntas. When checked the RTC online for the Survey No in that I came to know that BDA’s Final Notification No.UDD 193 MNX 2004 dated: 23-02-2004 has acquired 2 acres out of 4 Acres 10 Guntas.

The Final Notification No.UDD 193 MNX 2004 dated: 23-02-2004 was published in the Karnataka Gazette dated:23-02-2004 in Part-III under Sub-section(1) of Section-19 of BDA Act-1976 (Karnataka Act-12 of 1976) for formation of layout Called “ARKAVATHI LAYOUT’’.

Now I am in a dilemma whether the above said property falls under the BDA acquisition or not.

If it does’t comes under the BDA acquisition is there any problem in buying this property since it’s comes under B Khata.

Hi All,

With the above said matter I have entered an agreement with the buyer by giving an Advance Amount of 5 lakhs (4 lakhs in Cheque and 1 lakh in Cash), after coming to know about the BDA Notification I did the stop payment of the Cheque and informed the seller that to return back the 1 lakh Cash amount. Now they have sold the property by gaining a profit by selling it to more than the agreed to me to an another buyer. So all this time I have waited that they will return the amount. Now when I asked for the same they are denying in giving back my entire 1 lac money.

Wanted to know how the same can be taken from them.

Please advice/suggest in this regards.

My friendly advice. Don't depend on public response on such critical matters. Consult lawyer(s) and make decision.
