Final Payment after defects liability period
Final Payment after defects liability period
My contractor is asking for a Post Dated Cheque(PDC) for the payment , to be made after the defects liability period ( 8 months) . Is that common ? I thought , there wont be any PDCs involved here, because in case if we have a conflict on the defects and I decide not to pay in full, the PDC will be a legal liability for me to honour it , right ?

If I were you, I would not do it. With all the vendors, I used to only pay a partial amount, till I received the materials and it was used at site, only after that they got the remainder payment, for fear that they would not provide any service I needed. Given that, I would definitely not have paid the withheld amount. By the way, mine just came to one year since completion and my builder did not even ask for it. I had to remind him and tell him, I want to clear the remainder. He was nice enough to come and get all the things (any small cracks etc) fixed and also told me, i can call him any time for anything further. SO perhaps, your contractor may also be that way, will come and do all the work, still I would not pay the full amount (even with a post dated cheque).
I have been through one bad experience and after that learned my lesson. We had someone come paint our house. The deal was, paint inside and out. For the interior painting, I had to stay home from work while they were in the house. The guy did a great job and finished all that. Then he told me, you can go back to work, we will finish up the outside, just pay me the money now. I was naive enough to believe them and paid the full amount - he never came back to finish the outside. Would not pick up my calls. I was getting ready to take him to consumer court, but did not want to deal with that aggravation.
